1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Cenkle Digital ("Company," "we," "us," or "our"), a company established in Turkey, governing your access to and use of the Tapstice mobile application ("App" or "Service") and the website at tapstice.com.
By downloading, installing, accessing, or using Tapstice, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through in-app notifications. Your continued use of the App after such modifications constitutes acceptance of the updated Terms. If you do not agree with the modified Terms, you should discontinue use and delete your account.
2. Eligibility
To use Tapstice, you must:
- Be at least 13 years of age (or 16 in the European Economic Area/UK, or the minimum age required by the laws of your country of residence)
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Service under applicable laws
- If under 18 (or the age of majority in your jurisdiction), have permission from a parent or legal guardian who agrees to these Terms on your behalf
By using the App, you represent and warrant that you meet these eligibility requirements. If we learn that we have collected information from a person who does not meet the minimum age requirement, we will delete the account and associated data promptly.
3. Account Registration
3.1 Account Creation
You may use some features of Tapstice without creating an account. However, certain features require account registration, which you can complete using:
- Google Sign-In
- Apple Sign-In
- Anonymous account (limited features; we strongly recommend linking to Google or Apple to prevent data loss)
3.2 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use at support@tapstice.com
- Ensuring your account information is accurate and up-to-date
3.3 Account Linking
If you start with an anonymous account, you may later link it to a Google or Apple account to enable cloud sync and prevent data loss. Once linked, the anonymous account is merged and the link cannot be reversed.
3.4 Username Policy
You may choose a username that will be visible to other players on leaderboards and social features. Usernames must comply with our content policies and may not contain offensive, inappropriate, or misleading content. Usernames are subject to automated content filtering and may be rejected or removed. You may change your username once per week.
3.5 One Account Policy
Each user may maintain only one active account. Creating multiple accounts to gain unfair advantages, circumvent bans, exploit referral systems, or manipulate leaderboards is prohibited and may result in termination of all associated accounts.
4. License and Use Rights
4.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal mobile device(s)
- Access and use the App for your personal, non-commercial entertainment purposes
4.2 Restrictions
You agree NOT to:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or disassemble the App
- Remove, alter, or obscure any proprietary notices
- Use the App for any commercial purpose without authorization
- Create derivative works based on the App
- Use automated systems, bots, or scripts to interact with the App
- Exploit bugs, glitches, or vulnerabilities (you should report them to support@tapstice.com)
- Use cheats, hacks, mods, or unauthorized third-party software
- Manipulate game mechanics, scores, or leaderboards
- Circumvent security measures, App Check verification, or access restrictions
- Use the App on rooted/jailbroken devices or emulators in a manner that compromises security or game integrity
- Interfere with or disrupt the integrity or performance of the App or its servers
4.3 Beta and Experimental Features
From time to time, we may offer beta or experimental features through Remote Config or feature flags. These features are provided "as is" without any warranties, may change or be removed without notice, and may not represent the final product.
5. Virtual Items and In-App Purchases
5.1 Virtual Currency and Items
Tapstice offers virtual currency ("Gems"), virtual items, power-ups (Slow Motion, Time Freeze, Shield, Target Expand), cosmetics (skins, trails, badges, themes), subscriptions (VIP Weekly, VIP Monthly), Battle Pass, special bundles, and other digital content (collectively, "Virtual Items"). You understand and agree that:
- Virtual Items have no real-world monetary value
- Virtual Items cannot be exchanged for real currency or items outside the App
- Virtual Items are licensed, not sold, to you
- We may modify, rebalance, discontinue, or remove Virtual Items at any time with reasonable notice
- Virtual Items are non-transferable between accounts or users
- The balance and availability of Virtual Items may be affected by system updates or maintenance
5.2 Purchases
All purchases are processed by Apple App Store or Google Play Store. By making a purchase, you agree to:
- The applicable platform's terms of service and payment terms
- Pay all charges at the prices in effect when incurred, including applicable taxes
- The automatic renewal terms for subscriptions (where applicable)
We verify all purchases server-side to prevent fraud. We do not receive or store your payment card details.
5.3 Refunds
All purchases are final and non-refundable, except as required by applicable law or platform policies. Refund requests must be directed to the platform where the purchase was made:
- iOS: reportaproblem.apple.com
- Android: Google Play Order History
If a refund is granted by the platform, the corresponding Virtual Items (e.g., Gems) will be revoked from your account. If the Gems have already been spent, the resulting negative balance will be deducted from future Gem earnings.
EU/EEA/UK Consumers: Under the EU Consumer Rights Directive, you have a 14-day right of withdrawal for digital content purchases. However, by making a purchase and consenting to immediate delivery of digital content, you acknowledge that you waive your right of withdrawal once the digital content has been delivered or the download has begun.
5.4 Subscriptions
If you purchase a VIP subscription (Weekly or Monthly):
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage and cancel subscriptions through your device's app store settings:
- iOS: Settings > [Your Name] > Subscriptions
- Android: Google Play Store > Profile > Payments & subscriptions > Subscriptions
- Cancellation takes effect at the end of the current billing period; you retain access until then
- No refunds or credits for partial subscription periods, except as required by applicable law
- Subscription prices may change; you will be notified in advance and must agree to the new price to continue
5.5 Piggy Bank and Special Offers
The Piggy Bank feature accumulates Gems during gameplay. Breaking the Piggy Bank requires a one-time in-app purchase. Special packs and time-limited offers may be available at discounted prices. All special offer terms are displayed at the time of purchase.
5.6 Referral Program
Tapstice may offer a referral program where you can earn rewards by inviting new users. By participating, you agree to:
- Share referral codes only through legitimate means
- Not create fake accounts or use deceptive methods to earn referral rewards
- Accept that referral rewards are limited to one reward per unique referred user (verified by device identifier)
- Accept that we reserve the right to modify, suspend, or terminate the referral program at any time
- Accept that abuse of the referral system may result in account suspension and forfeiture of rewards
6. User Conduct
6.1 Acceptable Use
You agree to use Tapstice in a manner consistent with all applicable laws and regulations. You must not:
- Violate any applicable laws, regulations, or third-party rights
- Engage in fraudulent, deceptive, or misleading conduct
- Harass, bully, threaten, or intimidate other users
- Upload or share content that is illegal, harmful, offensive, sexually explicit, or inappropriate
- Impersonate any person or entity
- Interfere with other users' enjoyment of the App
- Attempt to gain unauthorized access to our systems or other users' accounts
- Transmit viruses, malware, or other harmful code
- Abuse the reporting system by filing false or frivolous reports
6.2 User Content
If you upload content (such as profile photos or usernames):
- You retain ownership of your content
- You grant us a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and store your content as necessary to operate, promote, and improve the Service
- Your content must not violate our content policies or any third-party rights
- We may remove content that violates these Terms without prior notice
- Content is subject to automated moderation (via Google Cloud Vision API for photos, content filters for usernames) and manual review
6.3 Content Moderation and Enforcement
We use both automated and manual content moderation to maintain a safe environment:
- Profile photos are automatically analyzed for inappropriate content using image recognition technology
- Usernames are checked against content filters for prohibited terms
- Users may report other users for violations through the in-app reporting system
- Violations are tracked per account. Enforcement actions include:
- Content removal and warning for first violations
- Temporary suspension (7 days) after 3 violations
- Permanent account ban after 5 or more violations
- You may appeal enforcement actions by contacting support@tapstice.com
6.4 Fair Play and Anti-Cheat
To ensure a fair gaming environment for all players:
- Cheating, hacking, or exploiting bugs is strictly prohibited
- Use of unauthorized third-party software, modified clients, or emulators for unfair advantage is prohibited
- Score manipulation, artificial inflation, or score-buying services are prohibited
- Game sessions are verified server-side using cryptographic session tokens and seed validation
- Scores that fail server-side verification may be automatically rejected
- We reserve the right to reset scores, remove rewards, revoke Gems, or ban accounts for confirmed violations
- Our anti-cheat decisions are final, though you may appeal by contacting support@tapstice.com
7. Intellectual Property
7.1 Our Intellectual Property
Tapstice and all associated content, including but not limited to:
- Software, code, algorithms, and anti-cheat systems
- Graphics, images, animations, and visual designs
- Audio, music, and sound effects
- Text, logos, and trademarks (including the "Tapstice" name and logo)
- Game mechanics, features, and game modes
- Website content and design
are owned by or licensed to Cenkle Digital and are protected by Turkish intellectual property laws, international copyright treaties, trademark laws, and other intellectual property laws. All rights not expressly granted are reserved.
7.2 Feedback
If you provide us with feedback, suggestions, or ideas, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate such feedback without compensation or attribution. You are not obligated to provide feedback.
8. Third-Party Services
The App integrates with third-party services including but not limited to:
- Apple Game Center and Google Play Games (achievements, leaderboards)
- Google Sign-In and Apple Sign-In (authentication)
- Google AdMob and Meta Audience Network (advertising)
- Firebase services (analytics, crash reporting, performance monitoring, push notifications, remote configuration, in-app messaging)
- Google Cloud Platform services (content moderation, data storage, analytics)
- Apple App Store and Google Play Store (purchases, subscriptions)
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, accuracy, availability, or practices of third-party services. See our Privacy Policy for details on data sharing with these providers.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the App will be uninterrupted, error-free, secure, or virus-free
- Warranties regarding the accuracy or reliability of any information obtained through the App
- Warranties that defects will be corrected or that the App will be compatible with your device
Jurisdiction-Specific Notices:
- EU/EEA/UK: Nothing in these Terms excludes or limits consumer rights under the EU Consumer Rights Directive, the UK Consumer Rights Act 2015, or other mandatory consumer protection laws. Digital content must be of satisfactory quality, fit for purpose, and as described.
- Australia: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms is intended to exclude, restrict, or modify rights under the Competition and Consumer Act 2010 (Cth).
- Turkey: This disclaimer is subject to mandatory consumer protection provisions under Turkish Consumer Protection Law No. 6502.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CENKLE DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:
- Loss of profits, data, or goodwill
- Service interruption or device damage
- Cost of substitute services
- Any damages resulting from your use or inability to use the App
- Loss of Virtual Items or game progress
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
Some jurisdictions (including the EU/EEA, UK, Australia, and Turkey) do not allow limitations on implied warranties or exclusion of certain damages, so some limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Cenkle Digital, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the App in violation of these Terms
- Your violation of any applicable law or third-party rights
- Your user content
- Any fraudulent or illegal activity conducted through your account
This indemnification obligation does not apply to the extent prohibited by the laws of your jurisdiction (including EU/EEA consumer protection laws).
12. Termination
12.1 Termination by You
You may stop using the App at any time. You may delete your account through the App settings ("Delete Account" option) or by emailing privacy@tapstice.com. Upon deletion, your data will be removed in accordance with our Privacy Policy.
12.2 Termination by Us
We may suspend or terminate your access to the App, with or without prior notice, for reasons including:
- Violation of these Terms or our content policies
- Fraudulent or illegal activity
- Confirmed cheating or anti-cheat violations
- Conduct harmful to other users or our business
- Accumulation of content moderation violations (see Section 6.3)
- Request by law enforcement or government agencies
12.3 Effects of Termination
Upon termination:
- Your license to use the App is immediately revoked
- You lose access to your account and all associated data
- Virtual Items and in-app purchases are forfeited with no refund (except as required by applicable law)
- Your personal data will be handled in accordance with our Privacy Policy
- Sections of these Terms that by their nature should survive (including Sections 7, 9, 10, 11, 13) will remain in effect
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal dispute proceedings, you agree to first contact us at legal@tapstice.com and attempt to resolve the dispute informally for at least 30 days.
13.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
13.3 Jurisdiction
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Istanbul, Turkey, except as otherwise required by mandatory consumer protection laws in your jurisdiction.
13.4 Arbitration Agreement
For users in jurisdictions where arbitration agreements are enforceable against consumers: Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered under the rules of the Istanbul Arbitration Centre (ISTAC), except that either party may seek injunctive relief in court for intellectual property violations.
13.5 EU/EEA/UK Consumer Exception
If you are a consumer in the EU/EEA or UK: Nothing in this dispute resolution section shall deprive you of the protection of mandatory consumer protection laws in your country of residence. You may bring proceedings in the courts of your country of residence, and you retain the right to use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
13.6 Brazilian Consumer Exception
If you are a consumer in Brazil: In accordance with the Brazilian Consumer Protection Code (CDC) and LGPD, you retain the right to bring proceedings before Brazilian courts and consumer protection bodies (PROCON). Mandatory arbitration clauses are not enforceable against consumers in Brazil.
13.7 Canadian Consumer Exception
If you are a consumer in Canada: Mandatory arbitration clauses may not be enforceable in certain Canadian provinces. You retain the right to bring proceedings in your province of residence in accordance with applicable consumer protection legislation.
13.8 Turkish Consumer Exception
If you are a consumer in Turkey: In accordance with Turkish Consumer Protection Law No. 6502, you retain the right to apply to Consumer Arbitration Committees (Tuketici Hakem Heyeti) for disputes below the monetary threshold, or to Consumer Courts for disputes above the threshold.
13.9 Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. This waiver does not apply in jurisdictions where class action waivers are prohibited.
13.10 Exceptions
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to intellectual property or unauthorized access.
14. Push Notifications
With your consent, we may send you push notifications related to:
- Daily rewards and streak reminders
- New features and game updates
- Special offers and promotions
- Social interactions (friend challenges, duel results)
- Account-related alerts
You can disable push notifications at any time through your device settings or the in-app notification preferences. Disabling notifications will not affect the core functionality of the App.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and Cenkle Digital regarding the App.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction, provided the assignee agrees to honor these Terms.
15.5 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, cyberattacks, or shortages of transportation, facilities, fuel, energy, labor, or materials.
15.6 Language
These Terms are written in English. If translated into other languages, the English version shall prevail in case of any inconsistency.
